ORANGEVILLE AND INNISFIL TWO-HATTER DECISIONS

 
 

Attention All OPFFA Locals,

On February 17, 2010 we attended the Judicial Review for the Innisfil grievance arbitration award issued by Owen Shime related to the 2-hatter issue and the Corporation’s assertion that the Local wrongfully interfered with management’s rights to hire. For anyone who has been to a Judicial Review you will understand the steep threshold to overcome to be successful at that level. Unfortunately for the Innisfil Local we received a verbal decision from the Judicial Review panel on that day denying the Local’s application. A written decision will follow.

However, in the following weeks Arbitrator Ken Swan issued his award in Orangeville. Although the situation was similar where the Corporation filed a grievance against the Local and issued disciplinary letters to the then President and Vice President Arbitrator Swan dismissed the Corporation’s grievance and upheld the Local’s conduct as legitimate union activity.

Obviously the Orangeville Local and the OPFFA are very pleased with this decision. For more information please see the attached decision and associated media coverage.

We recognize the difficulties that this issue has placed on many Locals and in particular our smaller affiliates. Notwithstanding the varied results we are proud of both the Innisfil and Orangeville Locals for standing firm in this regard and defending their collective agreements and our constitution.
